Welcome to Good Wine ("App," "Service," "we," "us," or "our"), operated by Good Wine LLC, a Washington limited liability company. By creating an account or using our Service, you agree to these Terms of Use ("Terms"). If you do not agree, do not use the Service.

1. Eligibility

You must be at least 21 years of age to use this Service. By creating an account, you represent and warrant that you are of legal drinking age in your jurisdiction. We do not sell alcohol. This App is a social platform for wine discovery, rating, and sharing.

2. Account Registration

You agree to provide accurate, current, and complete information during registration, including your date of birth. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

3. User Content

"User Content" means any photos, tasting notes, ratings, reviews, or other materials you submit through the App.

License Grant. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display your User Content in connection with operating and improving the Service. This license continues even if you stop using the Service.

Machine Learning. You acknowledge and agree that we may use your User Content, including wine label images, to train, improve, and develop machine learning models for label recognition, wine identification, and related features. These models may be used within the Service or in future products.

Your Responsibilities. You represent that you own or have the necessary rights to submit your User Content and that it does not violate any third party's intellectual property or other rights. You are solely responsible for your User Content.

Content Standards. You agree not to submit content that is illegal, defamatory, harassing, threatening, obscene, or otherwise objectionable. We reserve the right to remove any User Content at our sole discretion.

5. Third-Party Services

The App integrates with third-party services including Google Maps, Amazon Web Services, and OpenAI. Your use of these integrations is subject to those providers' terms of service and privacy policies. We are not responsible for the practices of third-party services.

When you upload wine label images, we may process them using third-party optical character recognition (OCR) and machine learning services to identify wine information. While we take steps to minimize transmission of personally identifiable information, background elements in your photos may be processed by these services.

6. Social Features

The App includes social features such as following other users, viewing their ratings and reviews, and saving recommendations. Information you share through these features may be visible to other users based on your privacy settings. You are responsible for what you share publicly.

7. Intellectual Property

All Service content, features, and functionality—excluding User Content—are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our materials without express written permission.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

Wine ratings and reviews reflect user opinions and should not be relied upon as professional advice. Drink responsibly.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow limitations on implied warranties or liability for certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

You agree to indemnify, defend, and hold harmless Good Wine LLC, its owners, officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms in the App or by other reasonable means. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Termination

We may suspend or terminate your account and access to the Service at any time, for any reason, without notice or liability. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive, including but not limited to: User Content licenses, disclaimers, limitations of liability, and indemnification.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in King County, Washington. You and we each waive the right to a jury trial and to participate in a class action.

For claims under $10,000, you may choose small claims court in King County, Washington instead of arbitration.

15. General Provisions

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Waiver. Our failure to enforce any provision of these Terms is not a waiver of that provision.

Assignment. You may not assign or transfer your rights under these Terms. We may assign our rights without restriction.
